ORDER

This Criminal Original Petition has been filed to direct the second respondent to execute a non bailable warrant issued against the 5th respondent/accused having Dis No.763-2022 dated 17.06.2022.

2. The learned counsel for the petitioner submitted that the petitioner had filed a complaint before the learned Judicial Magistrate No.I, Vellore in C.C.No.293 of 2005 and the same has been transferred and taken on file by the learned Judicial Magistrate, Fast Track Court, Vellore in C.C.No.480 of 2011. The trial is over in this case. When the matter is posted for pronouncing of judgment, the fifth respondent escaped from the Court. Therefore, Non Bailable Warrant has been issued against the fifth respondent and the same is 2/4

pending without execution from 2015 onwards. Therefore, this petition has been filed.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondents 1 to 4.

4. The case in C.C.No.480 of 2011 is pending from 2011 and the Non Bailable Warrant issued against the fifth respondent is pending from 2015 without execution. Therefore, the respondents 1 to 4 are directed to execute the Non Bailable Warrant issued against the fifth respondent within a period of 10 days from today and file the compliance report before this Court.

5. With a above direction, this Criminal Original Petition stands closed for the present.
