The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offences under Sections 4(1)(aaa), 4(1-A) of TNP Act r/w Sections 5, 6 and 7(a) of Tamil Nadu Rectified Spirit Rules 2000, in Crime No.469 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and other accused were found in illegal possession of 350 litres of ID Arrack. Hence, the complaint was registered as against the petitioner.
3. The learned counsel for the petitioner would submit that already the petitioner was granted anticipatory bail by this Court, on 20.07.2022, in Crl.O.P.No.17081 of 2022. However, the petitioner was unable to surrender and execute the sureties as directed by this Court. Therefore, the petitioner has again filed the present petition seeking for anticipatory bail.
4. The learned Additional Public Prosecutor admitted that the petitioner was earlier granted anticipatory bail by this Court. However, the petitioner has not executed the sureties as directed by Court. He also submitted that the petitioner is having 20 previous cases pending against him. 5. Though, this Court had granted anticipatory bail to the petitioner, the petitioner failed to surrender before the concerned Jurisdictional Magistrate and execute the sureties. That apart, the petitioner is also having 20 previous cases pending against him.
6. Taking into consideration the facts and circumstances of the case and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
