The petitioner worked as Superintendent in Highways Department and on attaining the age of superannuation retired from service on 30.06.2008. The petitioner was not paid increment due on 01.07.2008 on the ground that he was not in service as on the date on which the increment was due. The petitioner having found that under similar circumstances, this Court allowed a writ petition filed by another employee in W.P.No.8440 of 2011 submitted a representation to the respondents on 09.02.2012 to consider his case for grant of increment. The said representation is stated to be pending on the file of the first respondent. The petitioner seeks a direction to the first respondent to dispose of the representation in the light of the earlier order in W.P.No.8440 of 2011, which was upheld by the Division Bench and ultimately by the Supreme Court. https://hcservices.ecourts.gov.in/hcservices/
2. The first respondent is directed to consider and dispose of the representation dated 09.02.2012 on merits and in the light of the order dated 03.08.2011 in W.P.No.8440 of 2011. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
3. The writ petition is allowed to the extent indicated above. No costs.
