Savarianandham v. The State Rep.By Its
Crl.M.P. No.14509 of 2022 in Crl.O.P. No.6960 of 2021 R.N.MANJULA, J., This Court has earlier passed an order to quash the FIR on 09.04.2021 by allowing Crl.O.P.No.6960 of 2021. In the short cause title, the name of the petitioner/accused is typed as Savari Anandan. The petitioner has filed the present Civil Miscellaneous Petition praying to amend his name as V.Savarianandham instead of Savari Anandan.
2. On perusal of FIR pertaining to Cr.No.434 of 2020 on the file of Thirumanur Police Station, Ariyalur District, it is seen that the name of the accused is mentioned as Savari Anandhan. The mistake has crept in the Criminal Original Petition filed by the petitioner himself, wherein the name of the petitioner has been wrongly mentioned as Savari Anandhan. The mistake is visible while comparing the name of the petitioner.
3. After clarifying the name of the petitioner with the FIR, I feel in the interest of justice, this petition should be allowed and the name of the petitioner should be amended as 'V.Savarianandham' instead of 'Savari Anandan'.
4. In the result, this Criminal Miscellaneous Petition is allowed and the Registry is directed to carryout necessary amendments in Crl.O.P. No.6960 of 2021 and issue a fresh order copy.
