In the affidavit in support of this application, it is stated that the applicant inadvertently failed to appear at the hearing on 18.04.2023, when the suit was dismissed for non-prosecution. In the counter, the respondent states that the suit was filed with the intention of impeding the peaceful conduct of business by the first respondent.

Upon considering the above pleadings, I am of the view that this application should be allowed subject to payment of a sum of Rs.10,000/- (Rupees Ten Thousand only) as costs by the applicant to the 1st respondent.
