The petitioner, who arrested and remanded to judicial custody on 19.03.2025 for the offences punishable under Sections 121(1) and 109 (1) of BNS Act in Crime No.138 of 2025 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner herein is one of the accused in Crime No.137 of 2025. Now, the case was registered in connection with the murder of one John. This is the case of retaliation for an earlier murder. According to the prosecution, this petitioner along with others, after committing the crime of murder, also attacked the police team, who tried to intercept them.

3.The learned Government Advocate (Crl.Side) submitted that on completion of investigation, final report filed and it is yet to be taken on file by the Court. He further submitted that this petitioner is having 14 previous cases which all are grevious in nature and if the petitioner releases on bail, there is every possibility of threatening the witnesses. 2/4

4. Taking note of the fact that the incident has taken place as an act of retaliation and also the fact that the government officials namely, the police, who tried to apprehend this petitioner, were attacked and the police vehicle got damaged and if the petitioner is released on bail, there is every possibility of threatening the witnesses and tempering the evidence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
