Respondents Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 2 & 3 to dispose of the representation of the petitioner dated 17.09.2021 on merits and
consequently delete the name of the respondents 5 & 6 from the revenue records and restore the name of the petitioner/original position after giving an opportunity of personal hearing to the petitioner. ORDER
This writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents 2 & 3 to dispose of the representation of the petitioner dated 17.09.2021 on merits ; consequently delete the name of the respondents 5 & 6 from the revenue records and restore the name of the petitioner, after giving an opportunity of personal hearing to the petitioner.
2. Heard, Mr.S.N.Kirubanandam, learned counsel appearing for the petitioner, Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the respondents 1 to 3 and Mr.S.Rajesh, learned Government Advocate appearing for the fourth respondent.
3. The petitioner lodged a complaint before the second respondent in respect of deed of conveyance executed in favour of fifth and sixth respondents
herein and it is pending. However, the petitioner did not implead the vendors of those deed of conveyance.
4. Considering the above, the second respondent is directed to conduct enquiry, after issuance of notice to the petitioner and the respondents 5 & 6 and the vendors of the respondents 5 & 6, by giving them an opportunity of hearing and shall pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
