No.37M/DB/AET/F.43(Boat)/2022, dated 11.03.2022 passed by the fifth respondent and quash the same as illegal ultra virus and thereby directing the respondent to release the withheld amount together with commercial rates of interest in terms of the agreement dated 28.09.2012 between petitioner and the fifth respondent and in terms of Letter No.8151/ISW/2015-12, dated 10.12.2018 issued by the first respondent in a time bound period. This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus thereby calling for the entire records pertaining to Lr. No.37M/DB/AET/F.43(Boat)/2022, dated 11.03.2022 passed by the fifth respondent and quash the same as illegal ultra virus and thereby directing the respondent to release the withheld 2/5

amount together with commercial rates of interest in terms of the agreement dated 28.09.2012 between petitioner and the fifth respondent and in terms of Letter No.8151/ISW/2015-12, dated 10.12.2018 issued by the first respondent in a time bound period. 2.The learned counsel appearing for the petitioner submitted that the petitioner entered into agreement with the respondents for manufacture and supply of two new boats, one FRP Boat and another Steel Boat to Mullai Periyar Dam for the use of Tamil Nadu Water Resources Department on 28.09.2012 and as per the agreement, the petitioner has to deliver the boats within a period of four months, however, the petitioner was not able to deliver the boats within the said period.

Hence, this Court may, without going into the merits of the case, grant liberty to the petitioner to work out the remedy before the appropriate forum in the manner known to law. 3.

4.The writ petition is dismissed with the above liberty. No costs.
