J U D G M E N T

(Delivered by S.S.SUNDAR, J.) The learned counsel appearing for the parties filed a memo dated 27.11.2024, which is in tune with the joint memo of compromise signed by the appellant and the respondent filed under Order XXIII Rule 3 CPC.

2. The joint memo of compromise dated 28.11.2024 is signed by the appellant and the respondent, in the presence of their counsels who also acknowledged the terms of compromise. Further, the parties are present before this Court and they stated that they have signed the memo of compromise on their own volition.

3. On the terms of the compromise memo, the respondent/plaintiff has agreed to receive a sum of Rs.24,50,000/-, in addition to the sum of Rs.10lakhs already received on 30.08.2016, by way of demand draft, in full quit and final settlement to the decree amount in C.S.No.534 of 2012. The payment of money is also acknowledged in the compromise memo. Therefore, the parties requested that the appeal may be disposed of based on the memo of compromise entered into between them.

4. Hence, this original side appeal is disposed of, in terms of the joint memo of compromise dated 28.11.2024 and the joint memo of compromise shall form part of the decree. No costs. Connected C.M.P. is closed. [S.S.S.R.,J.] [P.D.B., J.] 28.11.2024 Internet : Yes gya 3/4
