O R D E R

The petitioner herein the landlord has let out his premises for lease to one Sangeetha. Later due to some misunderstanding between the landlord and the tenant, a complaint being given by Sangeetha and enquired by the Police in CSR No.287 of 2024. In the course of the enquiry, the petitioner has agreed to return the advance of Rs.2,90,000/-. The said Sangeetha has taken back her advance money and vacated the premises. While so, for the balance sum of Rs.10,000/-, the petitioner herein has given a complaint to the respondent Police on 10.07.2024.

2. The learned counsel appearing for the petitioner submits that under the guise of investigation, the respondent Police is pressurizing him to pay back the balance Rs.10,000/- to the said Sangeetha, the amount which was retained for the repair charges.

3. The learned Government Advocate (Crl. Side) submits that the earlier case in CSR No.287 of 2024 given by Sangeetha was closed, after the petitioner has repaid the advance amount of Rs.2,90,000/-. As far as the complaint given by the petitioner summons was issued to Sangeetha 2/4

as well as the petitioner but both did not turn up for enquiry.

4. The allegation against the Police in this petition is that under the guise of enquiring the complaint, the petitioner was put to harassment. However, the said allegation is denied by the Police and in fact no complaint is against the petitioner pending, only his petition is under investigation. Since, the said Sangeetha has already vacated the premises and not participated in the enquiry, this Court is of the view that the Police need not trouble the petitioner hereafter and close his complaint against Sangeetha.
