Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Central Rules, 1998, insofar as the same purport to confer upon the Welfare Board any power to discontinue, withdraw, abandon or permanently suspend an approved welfare scheme funded out of the Welfare Fund without express statutory sanction under the BOCW Act, 1996, are ultra vires to the Sections 22, 24 and 62 of the Act and violative of Articles 14, 21 and 47 of the Constitution of India, 1950, and consequently void and unenforceable to that extent.
