The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296, 115(2), 118(1) of BNS, 2023, in Crime No. Not known of 2024, seeks anticipatory bail.

2. When the matter was taken up, the learned Public Prosecutor (Puducherry) submitted that this petition been filed without any crime number and also without disclosing the correct provisions of law. The FIR has been registered on 11.07.2024 in Cr.No.114 of 2024 for the offences punishable under Sections 296 and 115(2) of BNS, 2023.

3. Whereas, on perusal of the Anticipatory Bail petition, this Court finds that the petitioner has filed as Crime Number not known of 2024 for the offences punishable under Sections 296, 115(2), 118(1) of BNS, 2023. As per the averments made by the learned Public Prosecutor (Puducherry) for the offences registered in Cr.No.114 of 2024, Sections 296 and 115(2) of BNS, 2023 are bailable in nature and grant of anticipatory bail to the petitioner would not arise at all.
