PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st, 3rd and 4th Respondents to issue patta to us for the land situated at Kilambakkam Village, Vandalur Taluk, Chengalpattu District comprised in Survey No. 126/4A for an extent of 18 cents by cancelling the patta granted to the 5th respondent For Petitioner : Mr.Karthikeyan Sekar For R1 to R4 : Mr.A.Selvendran Special Government Pleader

O R D E R

The petitioners herein seek a direction to respondents 1, 3 and 4 to issue patta in their names in respect of land situated in Survey No.126/4A at Kilambakkam Village, Vandalur Taluk, Chengalpattu District after cancelling the patta issued in the name of 5th respondent

2. According to the petitioners, the above mentioned property is their ancestral property and the patta was wrongly issued in the name of 5th respondent in respect of 18 cents. Therefore, the petitioners submitted representation on 04.09.2019 before the 2nd respondent seeking modification of entry in the revenue records by deleting the name of 5th respondent and 2/6

including the name of the petitioners and the same has not been considered by the 2nd respondent. The learned counsel for the petitioner also submits that Village Administrative Officer and the Revenue Inspector have submitted report in favour of petitioners. The petitioners made several representations to the respondents and last of the representation was submitted on 13.02.2024 by the petitioners to 3rd respondent and the same has not been considered till date. Hence, the petitioners are before this Court.

3. The learned Special Government Pleader, who is taking notice for the respondents 1 to 4, submitted that representation of the petitioners will be considered on its' own merits within a time fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioners, this Court is inclined to direct the 3rd respondent to consider the representation of the petitioners dated 13.02.2024 and pass final orders on its' own merits within a period of eight weeks from the date of receipt of copy of this order after issuing necessary notice to the 4th respondent. 3/6
