Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the first respondent to consider the appeal of the petitioner dated 10.12.2018 seeking to enhance the compensation awarded by the second respondent, the Special Tahsildar (LA), Tamil Nadu Road Sector, Vridhachalam, Cuddalore District for the land already acquired for road expansion project.

ORDER

This Writ Petition has been filed for the issuance of Writ of Mandamus, directing the first respondent to consider the appeal of the petitioner dated 10.12.2018 seeking to enhance the compensation awarded by the second respondent, the Special Tahsildar (LA), Tamil Nadu Road Sector, Vridhachalam, Cuddalore District for the land already acquired for road expansion project.

2.There is no representation for the petitioner. Heard Mr.G.Krishna Raja, learned Additional Government Pleader appearing for the respondents.

3.The petitioner owned land comprised in R.S.No.9/3, to an https://hcservices.ecourts.gov.in/hcservices/

extent of 1647 sq.ft, situated at Plot No.19 of Alli nagar, C.Thandeeswaranallur, Chidambaram Taluk. The said land was acquired for the purpose of expansion of Tamil Nadu Road Sector Project, Vridhachalam by the second respondent and passed an award for compensation at Rs.3944/- (Rupees Three Thousand Nine Hundred and Forty Four only) by the award dated 12.09.2008 in Award No.18 of 2008. Aggrieved by the same, the petitioner filed an appeal before the first respondent on 10.12.2018, for enhancement of compensation.

4.In view of the above, the first respondent is directed to issue notice to the petitioner and after giving an opportunity of hearing to the petitioner, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, if not already disposed of.

5.With the above directions, this writ petition is disposed of. There shall be no order as to costs.
