Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing 1st and 2nd respondent herein to consider the candidature of the petitioner under the priority quota for the post of Drawing /Art Teacher in the Government school. The relief sought for in this writ petition is for seeking to issue a direction to the 1st and 2nd respondents herein to consider the candidature of the petitioner under the priority quota for the post of Drawing /Art Teacher in the Government school.

2. The counter affidavit filed by the third respondent in this regard states that the petitioner has made a representation on 21.05.2010 in the District Employment Office, Tirunelveli praying to classify him under Land Acquisition priority category. Based on his representation, he was classified under Land acquisition priority category on the same day on 21.05.2010. However, the above selection of candidates to the post of "Drawing Teacher" was finalised on the basis of the state wide seniority list on 11.11.2009 itself. Therefore, the name of the petitioner who was classified under priority category at a later date (i.e) 21.05.2010 could not be included in this list.
3. In view of the counter statement, this Court is not inclined to issue any such direction as such sought for in this writ petition. In fact the grievance of the writ petitioner was considered by the respondent and it is found that even before the inclusion of the name of the petitioner, selection list was finalised. Hence, there is no further adjudication needs to be undertaken in this writ petition. Accordingly, the Writ Petition stands dismissed. However, there shall be no order as to costs.
