The petitioner seeks withdrawal for a sum of Rs.1,25,000/- which had been deposited to the credit of crime No.186 of 2022 as per the condition for grant of anticipatory bail. It is sought on the ground that final report had been filed dropping charges before the learned Judicial Magistrate. The learned Magistrate is having the option to reject the final report of the respondent or even to direct further investigation.
2. At this stage, the application filed is pre-matured and the petition stands dismissed. Liberty is given to file any application in accordance with the orders passed by the learned judicial Magistrate if at all there is a protest petition made with respect to the final report filed.
3. Heard both sides.
4. Accordingly, this Criminal Miscellaneous Petition stands dismissed.
