Application filed seeking to condone the delay of 64 days in filing written statement.

2. In the affidavit filed in support of this application, it had been stated that when the summons was served on the Society, the President was away from India and therefore instructions could not be given for preparing the written statement. Thereafter, documents had to be collected and after that owing to administrative exigencies, there was a delay in filing the written statement.

3. Heard the learned counsel for the respondents/plaintiffs also.

4. In view of the reasons stated, the petition stands allowed. The delay is condoned. The written statement is taken on file.
