The petitioner, who was arrested and remanded to judicial custody on 02.09.2022 for the offences punishable under Sections 294(b), 341, 420 & 506(ii) of IPC r/w Section 27(1) of Arms Act, in Crime No.564 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the second accused is liable to pay a sum of Rs.8,25,00,000/- to the de-facto complainant. When the defacto complainant asked to repay the said amount, the second accused had sent the rowdy elements/accused 1, 3 & 4 to threaten de-facto complainant with the pistol to evade the repayment of the said amount. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that this is the second application for bail. He would also submit that it is a put up case against him. Therefore, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioner is a habitual offender and he was arrested very recently i.e., on 01.09.2022 and this Court has very recently i.e., on 13.09.2022 had dismissed his first application for bail. Therefore, he vehemently opposed to grant bail to the petitioner.

5. Heard both the learned Counsel and perused the materials available on record.

Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel and also taking note of the fact that the antecedence of the petitioner and that this Court has very recently on 13.09.2022 had dismissed the application for bail, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed for the present.
