3. On being satisfied with the averments stated in the affidavit filed in support of the petition and also considering the submissions made by the learned counsels appearing on either side, this petition is allowed.

Accordingly, the petition is ordered.

4. Registry is directed to carry out necessary amendment in the cause title.
