Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 01.11.2021 to assess, determine and pay compensation to the petitioner for the damages caused due to passing of 800 KV HVDC Raigarh - Pugalur Transmission Lines'' PKG-01 for the property situated at No.203/4, Ramapuram Medu, Veerichetipalli Village, Varadhareddypalli Post, Gudiyatham Taluk, Vellore District in Survey Nos.173/3A, 173/2A1, 463/1, 463/6D.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents to consider the representation of the petitioner dated 01.11.2021.

2. The case of the petitioners is that he is owning the lands and doing agriculture. During the year 2013, the petitioner constructed a house in 1000 sq. ft. In order to install the high tension towers, the Power Grid Corporation issued a notice to the petitioner on 11.08.2018. The said Corporation have assessed only crops and trees, but, they failed to assess the house and well. On 22.02.2021, the petitioner gave a representation to the first respondent for compensation and on 08.03.2021, the Village Administrative Officer, Gudiyatham issued certificate stating that the petitioner is eligible to receive compensation for the house. Again the petitioner made a representation to all the respondents on 01.11.2021 to assess his house and the properties, the same was not considered by the respondents. Hence, the petitioner filed the present writ petition before this Court seeking appropriate directions.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the 5th respondent to consider the representation of the petitioner dated 01.11.2021 within the time stipulated by this Court.

4. The learned Standing counsel for the 5th respondent submitted that the petitioner's representation dated 01.11.2021 will be considered on merits and in accordance with law within the stipulated time as fixed by this Court.

5. Heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondents 1 to 3 and the learned Standing Counsel for the 4th respondent and perused the materials available on record.

6. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the 5th respondent to consider the petitioner's representation dated 01.11.2021 and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. No costs.
