Prayer : Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure, seeking to withdraw the case in HMOP.No.4476 of 2021 on the file of the V Additional Family Court, Chennai and transfer to the Family Court, Villupuram.

O R D E R

The wife seeks transfer of HMOP No.4476 of 2021 on the file of the V Additional Family Court, Chennai, to the Family Court at Villupuram.

2. Transfer is sought for mainly on the ground of convenience, since the wife is the resident of Kizperumbakkam Village in Villupuram Distict, the husband is the resident of Old Washermenpet in Chennai. If the proceedings are transferred to Family Court at Villupuram, the husband will have to appear for every hearing before the Family Court and he will be put to inconvenience.

3. Considering the same and the convenience of the wife, I am of the opinion that the OP could be transferred to a Sub Court, where the parties need not appear in person for every hearing. In such view of the matter, HMOP NO.4474 of 2021 (wrongly mentioned as HMOP No.4476 of 2021 in the Transfer Petition) is withdrawn from the V Additional Family Court, Chennai and transferred to the file of the Principal Sub Court, Villupuram to be tried and disposed of in accordance with law. https://hcservices.ecourts.gov.in/hcservices/

The learned Principal Sub Court, Villupuram is required to dispose of the OP within the period of one year from the date of receipt of the records from the transferor Court.

4. The Transfer Civil Miscellaneous Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
