ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 420, 468, 471 of IPC in Cr.No.15 of 2017, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused created the fabricated documents for the subject property and sold it to the defacto complainant to the tune of Rs.1,00,00,000/-, . Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that the petitioner is a practising Advocate. He further submits that for the above offence, the respondent police issued 41 A class 3 of Cr.P.C notice directing the petitioner to appear before the police for interrogation on 20.11.2021 but he was unable to appear on that day due to heavy rain. He further submits that he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Counsel for Intervenor submits that the amount involved in this case is more than Rs.21⁄2 crores. He further submits that the complaint has been lodged in the year 2017 and it is pending for more than 41⁄2 years. He further submits that the petitioner is a habitual offender and he along with other accused fabricated documents for the subject property and sold it to the defacto complainant to the tune of Rs.1,00,00,000/.

5. The learned Government Advocate (Crl.Side) raised objection stating that the there are about Rs.2,50,00,000/- was involved in this case, the petitioner along with others cheated various persons by using fabricated documents. He further submits that the investigation is still pending .

6. Considering the gravity of the offence committed by the petitioner and also considering the fact that that amount involved in this case is huge, this Court is not inclined to grant anticipatory bail to the petitioner.
