PRAYER: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus directing the respondents to laying of Village paddy field road under the Pradhan Mantri Gram Sadak Yojana [PMGSY] comprised in Survey No.307/3, Eduthavainatham Village, Chinnasalem Taluk, Kallakurichi District, measuring an extent of 500 meters length and 5.6 meters in width, provides vital access to the petitioner and other agriculturist and also other villages for agricultural property within stipulated time.

This writ petition has been filed to direct the respondents to lay the Village Paddy Field Road, under the Pradhan Mantri Gram Sadak Yojana [PMGSY] in S.No.307/3, Edutahvainatham Village, Chinnasalem Taluk, Kallakurichi District, measuring 500 meters in length and 5,6 meters width, within a stipulated time.
2.The petitioner states that the Village Panchayat of Eduthavainatham Village, originally laid a cart track measuring 600 feet in length and with a width of 18 feet, for public usage 30 years ago and that the said cart track was the only access road connecting Eduthavainatham village to Kachirapalayam. While so, the villagers requested the local panchayat, to lay the tar Road on the existing cart track, so as to enable them to carry their agricultural products from Eduthavainatham Village to Kachirapalayam, as no alternative pathway was available. Since the respondents failed to respond, the petitioner submitted a representation on 10.01.2025, to the respondents requesting them to lay the tar road on the existing cart track in Page No.2 of 4
S.No.307/3, Eduthavainatham Village, Chinnasalem Taluk, Kallakurichi District. However, the respondents failed to respond to the representation also and so the petitioner filed the writ petition for the aforesaid relief. 3.Heard both sides and perused the materials on record. 4.Under the facts and circumstances of the case, without entering into the merits of the case, this Court deems it appropriate to issue a direction to the respondents, to consider the petitioner's representation dated 10.01.2025, and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 5.With the above direction, this writ petition is disposed of.
