Mrs.Megala ..Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents herein to consider petitioner representation dated 27.04.2024 to cancel the patta No. 53 which had been given in the name of the 6th respondent and handover the lands to the respective Legal Heir of the original Owners / pattadharars who had provided the lands to the school for the common purpose. The petitioner herein seeks a direction to respondents to consider his representation dated 27.04.2024 seeking cancellation of patta issued in the name of 6th respondent in respect of property in Survey No.177/23 with an extnt of 67 cents in T.Palur Colony, Udayarpalayam, Ariyalur District.
2. It is the case of the petitioner that the above said property was originally belonged to his forefathers' and the same was gifted to school established for the welfare of the Scheduled Castes and the Scheduled Tribes. The 6th respondent obtained patta in respect of the above said land gifted for 2/4
school illegally and therefore, the petitioner submitted a representation dated 27.04.2024 before the 1st respondent seeking cancellation of patta and the same has not been considered. Hence, he is before this Court.
3. The learned Special Government Pleader, who is taking notice for the respondents 1 to 5, submitted that the representation of the petitioner will be considered on its' own merits within a time fixed by this Court.
4. In view of the same, this Court, without going into the merits of the claim made by the petitioner, is inclined to direct the 3rd respondent to consider the representation of the petitioner dated 27.04.2024 and pass final orders on its' own merits within a period of eight weeks from the date of receipt of copy of this order after issuing necessary notice to the 6th respondent.
