A.No.4201 of 2022 is filed to condone the delay of 117 days in filing restoration application in T.O.S.No.4 of 2014 which was dismissed on 21.04.2022.

2.The learned counsel for the applicant/plaintiff submitted that previous counsel appearing for the applicant/plaintiff died due to Covid-19. Therefore, this delay occasioned.

3.The learned counsel for the respondent prays time for filing counter. Sufficient time was given for filing counter. Still counter is not filed. 4.Considering the reasons stated in the affidavit, this Court finds that the reason for the delay is the death of earlier counsel and in the considered view of this Court, this delay has to be necessarily condoned. In this view of the matter, this application is allowed. Delay of 117 days in filing restoration application is condoned.
