ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.05.2025, for the alleged offence punishable under Sections 8(c) r/w 20(b)(ii)(C), 28, 29 of NDPS Act in Crime No.WO/48/1/10/2025/NCB/MDS , on the file of the respondent police, seeks bail.

2. The allegation of this petitioner is that this petitioner joining hands with other accused while transporting 216 kgs of ganja in the Ashok Leyland bearing Registration No. AP16TF3401 from Andhra Pradesh to Tamil Nadu and while the vehicle entered into Nallur Toll Plaza, police intercepted and arrested and statements were also recorded. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 07.05.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that A1 and A2 were travelled in the same vehicle, they were aware about the contraband which is the huge quantity it was hidden in the lorry and the same was seized at Nallur Toll Plaza, and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, the contraband seized from the petitioner while she was travelling along with A1, rigours of Section 37 of NDPS Act is applicable to the petitioner, and this Court is not inclined to grant bail to the petitioner.
