ORDER

The petitioner is the husband who has filed OP.No 618/2025, which is pending before the VII Additional Family Court, Chennai. 2.The counsel for the petitioner states that earlier, the petitioner and the respondent had filed a mutual consent divorce petition, and the same was numbered in OP.No.796/2024, and in furtherance of the settlement, the petitioner had also executed a settlement deed in favour of the respondent/wife; however, after having taken advantage of the settlement in her favour, the respondent did not cooperate for disposal of OP.No.796/2024, and after several adjournments and repeated non-appearances on the side of the respondent, the said 13(B) petition for mutual consent divorce, was dismissed. This has necessitated the petitioner to move the present OP.NO.618/2025. 3.

Apart from this, the learned counsel for the petitioner would also state that even as early as in 2013 the petitioner had moved for dissolution of marriage in OP.NO.4439/2013, and the wife had also filed OP.No.1720/2014 for restitution of conjugal rights.

It is also brought to my notice that even in the present proceedings the respondent has not entered appearance till date. 5.In the light of the above and the fact that the respondent has taken advantage of the settlement executed in her favour in respect of valuable immovable property and thereafter has abstained from appearing before the Family Court to enable the mutual consent divorce petition to be ordered, thereby forcing the petitioner to file the present OP No. 618/2025, I am inclined to direct the VII Additional Family Court, Chennai, to expedite the hearing in the said OP and dispose of the same within a period of nine months from the date of receipt of a copy of this order.
