ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 1 st respondent to dispose the petitioner's appeal dated 16.11.2023 within a stipulated period of time.

3.It is submitted by the learned counsel for the petitioner that the Appeal was preferred on 16.11.2023 against the proceedings of the second respondent in Pa.Mu.A2/1125/2023 dated 20.10.2023, wherein petitioner's request for issuance of patta was rejected in respect of property comprised in Survey No.673/2G, 673/2H & 673/2I and the same is stated to be pending. Aggrieved by the same, the petitioner has come before this Court. 4.At the outset, it was submitted by the learned Government Advocate for respondents that the Appeal dated 16.11.2023, made by petitioner would be considered and appropriate orders would be passed within a time frame fixed by this Court, which was agreed to by the learned counsel for petitioner. 2/4

5.In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent to consider the Appeal dated 16.11.2023, made by the petitioner on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested persons, including rival claimants, if any, within a period of twelve (12) weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the Appeal and it is open to the respondent concerned to consider the Appeal on its own merits and in accordance with law.
