O R D E R

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the Respondent to consider the Petitioner's representation dated 04.04.2025 and operate the waiting list under the EWS quota for the post of Field Assistant, Level-2 for immediately filling the existing vacancy, in accordance with the Recruitment Notification bearing No.39399/DOSLR/FR/EXAM/2022 dated 12.12.2022 and Memorandum No.39399/DSLR/EStt./EC-II/2022-23 dated 27.10.2023 issued by the Respondent.

3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the 2/6

petitioner belongs to the Economically Weaker Section (EWS) Category and he has applied for the post of Field Assistant in pursuance of the notification issued by the respondent in Notification No.39399/DOSLR/FR/EXAM/2022, dated 12.12.2022. It is the specific submission of the petitioner that he is eligible to be appointed under EWS Quota, where the petitioner is a wait listed candidate. The learned counsel for the petitioner would further submit that out of three candidates selected under the EWS Quota, two of them become ineligible at the time of certificate verification. Therefore, the petitioner has to be considered for such vacancy. In this connection, the petitioner has sent a representation to the respondent on 04.04.2025 requesting the respondent to operate the waiting list and such representation is pending with them.

At this juncture, the learned Government Advocate (Pondicherry) appearing for the respondent would submit that the file is pending with Department of Personnel and Administrative Reforms and would submit that they would consider the petitioner's representation according to it's own merits and in accordance with law, within a reasonable time.

6. In such view of the submission, without going into the merits of the 3/6

writ petition, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 04.04.2025 and pass orders on it's own merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.
