ORDER

This contempt petition is filed to initiate appropriate contempt proceedings against the respondents for deliberate and wilful disobedience of the order passed in W.P.No.19757 of 2025 dated 29.05.2025, and to direct the

respondents to immediately comply with the original order by permitting the petitioner to apply and submit her results, and to safeguard the petitioner's right to be fairly considered for admission to legal education based on her eligibility. 2.Heard both sides.

3.Learned counsel appearing for the petitioner submits that the order passed by this Court dated 29.05.2025 has not been complied by the respondents.

4.Learned counsel appearing for the respondents 1 and 2 submitted that they have filed a detailed counter affidavit stating that they have not committed any contempt as contended by the learned counsel for the petitioner. 5.On perusal of records, it is seen that the petitioner sought for admission in Tamil Nadu Dr.Ambedkar Law University for the academic year 2025-2026. The cut off marks for merit list candidates for BC (O) is 96.500. For better appreciation, table provided in the counter affidavit with regard to cut off mark is reproduced hereunder:

Further more, she had not made any formal application as mandated by the Law University to any of 5 year integrated courses conducted by the Law University.

7.For better appreciation, relevant paragraphs of the counter affidavit are extracted hereunder:

"6.In this regard it is humbly submitted that the Petitioner had miserably failed to comply with any of the formalities for admission. The petitioner had neither made any formal application as mandated by the Law University to any of the 5 year integrated courses conducted by the Law University. A mere email cannot be construed as an application and mere submission of mark statement through email cannot entail that she had applied for any of the courses. The Petitioner had not personally visited the law University either requesting for submission of application or even to enquire about the formalities to effectuate the order passed by this Hon'ble Court. Even in this affidavit, the Petitioner had not stated as to which course she would want to apply for admission.

Moreover, it was clearly explained to the petitioner's Counsel who visited the University that considering the marks obtained by the petitioner she cannot secure admission in any of the courses conducted by the Law University. Despite, knowing that she has not secured the necessary cut-off to secure admission, the petitioner has approached this Hon'ble Court with the sole intention to abuse the process of law and secure admission.

7.The other averments in the other paragraphs of the contempt petition are hereby vehemently denied. The petitioner has miserably failed to comply with any of the formalities for admission. Moreover, she had not secured the necessary cut off marks to secure admission to any of the 5 year integrated courses conducted by

the Law University which is very much evident from her own submission in paragraph 6 of the above contempt petition. The petitioner had secured only 85.25% whereas the cutoff marks required for a BC candidate even to be placed in the waitlisted category is more than 90%. The Cut-off marks which are tabulated above were also published in the University's website and the Petitioner is very much aware of the said fact. The admission for all the 5 year integrated law degree courses conducted by the Law University is complete and classes have commenced from 23.06.2025 onwards. The Petitioner herein could not secure admission as she did not fulfill any of the requisite formalities prescribed for admission. Thus, there is no willful disobedience or disrespect by me or any of the personnel at the Law University to the orders passed by this Hon'ble Court and in the light of the above submissions, the above contempt petition is liable to be dismissed with exemplary costs."

From the above paragraphs, it is clearly reveal that the petitioner has not even completed the requisite formalities as mandated by the Law University. Hence, there is no contempt on the part of the respondents and no violation of the orders passed by this Court as contended by the learned counsel for the petitioner.
