The second petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 102(B), 406 and 420 of IPC in Crime No.28 of 2023, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and the first accused, who is her husband had commenced the business in the name of "Sri Promoters" and assured that they would get building plan approvals and engaged the defacto complainant to invest money in the business. In this manner, a total sum of Rs.1,52,00,000/- (Rupees One Lakhs and Fifty Two crores) had been collected from about 16 persons.
3. In the previous hearing date ie., on 07.09.2023, it had been stated by the learned counsel that Rs.1,50,00,000/- had been paid. An affidavit was directed to be filed. But till date, no such affidavit had not been filed even though further time was granted on 14.09.2023. C.V.KARTHIKEYAN , J.

4. It is clear that such statement had been made without any basis.
5. The learned Government Advocate (Crl.Side) appearing for the respondent has raised serious objection stating that the amounts had been secreted away from nearly about 16 victims and also stated that the first accused had been taken into custody and not released on bail.
6. In view of the above circumstances, this Criminal Original Petition stands dismissed.
