ORDER

This Writ Petition has been filed to consider the Petitioner's representation dated 01.04.2019, which was submitted for cancellation of Joint Patta No. 728 issued jointly for the property, situated at Thimmachur Village, Thirukoviloor Taluk, Villupuram District, Patta No. 115, Comprised in Punja Survey No. 234/ 2, to an extent of 0.31 cents to and in favour of the Respondents 4 to 19 and issue Patta in favour of the petitioner.

2. The learned counsel appearing for the petitioner would submit that admittedly, patta stands in the name of the petitioner, however, subsequently, joint patta was issued in the name of private respondents, thereby the petitioner made a representation to cancel the joint patta issued to the private respondents, however, no order was passed, hence the present writ petition.

3. Per contra, the learned Government Advocate appearing for the respondents 1 to 3 submits that the prayer of the petitioner cannot be granted 3/6

and if the petitioner intends to cancel the joint patta, the petitioner has to make an application before the Tahsildar or before the Revenue Divsional Officer.

4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3 and perused the documents placed on record.

In the present case, the petitioner made a representation to the 2 nd respondent for cancellation of the joint patta, in view of the same, this Court is inclined to direct the petitioner to submit a copy of the representation dated 01.04.2019 along with a copy of this order to the 2 nd respondent and the 2 nd respondent shall consider the same and pass appropriate orders after providing opportunity to the petitioner as well as the aggrieved persons including the private respondents within a period of six weeks from the date of receipt of copy of this order, if not already passed.
