Respondent PRAYER: This Criminal Original Petition has been filed under Section 528 of BNSS Act, praying to set aside the order in Crl.M.P.No.263 of 2025 dated 20.02.2025 passed by the learned Additional District Judge/Presiding Officer, Trial of Cases under Essential Commodities Act, Coimbatore and to permit the petitioner to release on his own bond surety in Crime No.816 of 2024 on the file of the respondent police.

O R D E R

The petitioner was granted bail by the trial Court on 18.12.2024 with the condition that he be released on bail upon executing a bond for a sum of Rs.10,000/- with two sureties for a like sum.

2. The contention of the petitioner is that he has no relatives, and none of his family members are coming forward to offer sureties. He has been estranged from his family, and in view of the above, the petitioner is unable to furnish sureties. Hence, he seeks modification of the bail condition to permit execution of a personal bond.

3. Considering that bail was granted on 18.12.2024 and almost eight months have passed since the order, and since the petitioner continues to remain in custody, it is evident that he has been unable to comply with the bail condition.

4. In view of the same, the condition is modified, and the petitioner is directed to execute a bond for a sum of Rs.5,000/- with one surety.

5. Accordingly, this petition is allowed.
