ORDER : The Court Made the following order :- The petitioner who was arrested on 03.03.2021 for the offence under Sections 376 and 506(ii) of I.P.C. in Cr.No.5 of 2021 on the file of the respondent police, seeks bail.

2.It is the case of the prosecution that the petitioner is the brother - in - law of the defacto complainant and he is alleged to have forcibly raped the defacto complainant at knife point. 3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. Side) would submit that earlier, the petitioner approached this Court by filing Crl.O.P.No.19529 of 2021 and this Court vide order dated 20.10.2021 has dismissed the said petition and vehemently opposed for grant of bail to the petitioner.

5.Considering the fact that the offence committed by the petitioner is heinous offence and since there is no change in circumstances subsequent to the order passed in Crl.O.P.No.19529 of 2021, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 07/12/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
