PRAYER : This petition has been filed under Section 482 of Cr.P.C , to call for the records in CC No.896/2021 on the file of the Learned fast Track Court No.V at Magisterial Level Saidapet Chennai for the alleged offence u/s 138 of NI act and quash the same.

The petitioners herein filed this petition to call for the records in CC No.896/2021 on the file of the Learned fast Track Court No.V at Magisterial Level Saidapet Chennai for the alleged offence u/s 138 of NI act and quash the same.

2. There is no representation on the side of the petitioner.

3. The learned counsel for the respondent submits that the petitioner had already filed the petition in Crl.O.P No. 5618 pf 2022 for similar prayer but it was withdrawn by the petitioner. Now, again the petitioner filed this petition.

4. Considering the above submissions, it reveals that the petitioner has

not approached this court with clean hands and also filed this petition to drag to on the proceedings. Hence, I am not inclined to allow this petition. Accordingly, this petition is dismissed. No costs. Consequently, connected miscellaneous petition(s), if any, is/are closed. 18.03.2024 pbl To The Public Prosecutor, High Court, Madras.
