2. Heard Mr.Premchander, learned counsel appearing for the petitioner/Insurance Company.

3. Mr.A.Jotheeswaran, learned counsel, appearing for the first respondent/claimant, did not raise any serious objection in allowing this petition. No representation for the second respondent.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 34 days in filing the above appeal is condoned.
