This matter is taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for the revision petitioners.

2. The learned counsel for Revision Petitioner would submit that this Court by an order dated 06.11.2023 allowed the above C.R.P.. However, the learned counsel would submit that there is variation in arraying the cadre of parties and hence, he prayed to modify the same. Accordingly, the matter is listed today.

3. Considering his submissions, in para 5 of the order, it shall be substituted as follows :- "5. The reason assigned by the Revision Petitioners is justifiable one and the suit is of the year of 2020. If opportunity is not given to cross-examine D.W.2, their valuable right will be defeated. At the same time, on seeing the conduct of the 1/3

petitioners, this Court is inclined to dispose of this C.R.P. with a condition to pay a sum of Rs.5000/- to the petitioners 1 and 2/defendants 2 and 5 within a period of two weeks from the date of receipt of copy of this order and on such payment, the respondents 1 and 2/plaintiffs are permitted to cross-examine the witness D.W.2"

4. Registry is directed to incorporate above correction in the Order of this Court in C.R.P.No. 3989 of 2023 dated 06.11.2023 and issue fresh order copy to the Revision Petitioner.
