..Respondent PRAYER : Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 12.11.2018 in include the petitioner's name in the legal heir certificate within a stipulated period that may be fixed by this Court.

O R D E R

The petitioner had given a representation dated 12.11.2018 to include her name in the legal heirship certificate which had already been issued with respect to the death of her father viz., Arumugam.

2.Heard, Mr. G.Balamanikandan learned counsel appearing for the petitioner and Mrs.P.Rajalakshmi learned Additional Government Pleader appearing for the respondent.

3. It is stated that in the legal heirship certificate, which was issued on 11.11.2013 by the Tahsildar, Kallakurichi, the brothers of the petitioner viz., Palanisami and Rajiv Gandhi were alone included. The petitioner as a daughter was not included as a legal heir of the father. This is wrong. Therefore, the petitioner gave a representation. https://hcservices.ecourts.gov.in/hcservices/

4. The respondent viz., the Tahsildar, Kallakurichi is directed to examine the representation given by the petitioner, which is dated 12.11.2018 and if as a fact that the petitioner is a daughter of Arumugam, include her name and issue a fresh legal heirship certificate on or before 31.01.2020.

5. With the above observations, the writ petition is disposed of. No costs.
