This Criminal Revision Case is filed against the order of acquittal in the matter arising out of a private complaint under Section 138 of Negotiable Instruments Act.

2. In view of the amendment and directions of this Court, any appeal by the victim against the order of acquittal to be filed under Section 378 of Cr.P.C., and Revision under Section 397 r/w.401 Cr.P.C., is not maintainable.

3. In the light of the above, the petitioner herein has filed a petition for transposing the Revision as Appeal. Since the prayer is inconsonance with the law in force, the petition is allowed.

4. The Registry is directed to convert the Revision as Appeal and list the matter.
