The petitioner, who was arrested and remanded to judicial custody on 26.07.2022 for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.326 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of 1.450 Kg of Ganja. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner was alleged to be found in possession of 1.450 Kg of ganja and he was arrested on 26.07.2022. Thereby, he seeks for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the petitioner is a habitual offender and he has got 2 previous cases of similar nature. He would further submit that in this case, investigation has been completed and the final report has been filed on 28.09.2022. He would further submit that there are 7 witnesses in this case

and the respondent would be able to complete the trial within a period of 4 months from today. Hence, he vehemently opposed to grant bail to the petitioner.

5. Recording the same and taking into consideration the fact that the petitioner is a habitual offender under NDPS Act, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed. However, direction is issued to the Special Court under EC & NDPS Act Cases, Salem to complete the trial as expeditiously as possible preferably within a period of 4 months from today. 30.09.2022 mpl
