ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 8(C) r/w 20(b)(ii)(C) and 25 of the NDPS Act in Crime No.1213 of 2019, seeks bail.

2. The case of the prosecution is that on 27.11.2019 the respondent police has received an information from his regular informant to the effect that two persons are on the way to sell the ganja. The said information was reduced into writing and immediately the permission with regard to the raid has also been obtained by the respondent police from his immediate superior. Thereupon, he has gone to spot with two police personnel for informant, the team has witnesses a two wheeler came in which the rider and billion rider have got a gunny bag each in their possession. After it was found that

both the bags have contained ganja totally 21 kgs of ganja. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner sell 21 kgs of ganja, co-accused already released on bail and now all are absconding and the 9 previous cases pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the allegations and the nature of the offences involved in this matter, 9 previous cases pending against this petitioner, this Court is not inclined to grant bail to the petitioner.
