Mr.A.Vinothraj, learned Standing Counsel takes notice on behalf of the respondent. By consent, the writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to settle the retirement benefits payable to the petitioner, by considering the representation of the petitioner dated 28.05.2025.

3.The learned counsel appearing for the petitioner would submit that the petitioner retired on attaining the age of superannuation on 30.04.2025 and has sent representation on 28.05.2025 claiming retirement benefits and such representation is pending with the respondent.

4.At this juncture, the learned Standing Counsel would submit that the Government has sanctioned the retirement benefits of the transport employees upto 2023 and would further submit that as and when the Government sanction the amount, the respondent would settle the retirement benefits to the petitioner. 5.I have given my anxious consideration to either side submissions.

6.The respondent is statutorily bound to settle the retirement benefits to the petitioner as soon as the employee retires. But while looking at the Government Order in G.O.(Ms.) No.34, Transport (T1) Department, dated 03.03.2025, it appears that the Government has disbursed retirement benefits of the respondent employees only till 2023. On the mere delay of the Government the petitioner's eligibility to get retirement benefits on retirement cannot be whittled down. 7.Hence, this Court directs the respondent to consider the petitioner's representation dated 28.05.2025 upon its own merits and in accordance with law and pass orders, within a period of eight weeks from the date of receipt of a copy of this order. 8.The writ petition is disposed of.
