2.Notice sent to the respondent through Court is returned with an endorsement ''addressee cannot be located''.

However, the private notice as permitted by this court, has been served on 10.01.2022 and the Tracking Sheet filed by the petitioner shows that service is completed.

3.Considering the nature of the application filed and having regard to the facts narrated in the affidavit filed in support of this miscellaneous petition, this Court is convinced that the delay of 37 days in filing the Second Appeal has been satisfactorily explained by the petitioner.

4.Since this Court is satisfied with the reasons stated in the affidavit filed in support of this petition, the Civil Miscellaneous Petition is ordered and the delay of 37 days in filing the Second Appeal is condoned.
