R.N.MANJULA, J., These petitions are filed to extend the time for a further period of four months to complete the investigation and file final report as per the direction given by this Court by its order dated 17.02.2022 in Crl.O.P. Nos.15798 & 15801 of 2021.
2. Earlier, by virtue of a common order of this Court dated 17.02.2022 made in Crl.O.P. Nos.15798 & 15801 of 2021, six months time has been granted to complete the investigation and file final report from the date of the said order. When the matter came up 'for reporting progress' on 03.08.2022, the learned Additional Public Prosecutor sought further time to complete the investigation and this Court has granted a further period of four weeks. Now the present petitions are filed seeking further extension of time of a period of four months to complete the investigation and file final report.
3. The learned Additional Public Prosecutor appearing for the petitioners, on instructions submitted that in this case investigation has already been completed however, charge sheet could not be filed due to the following reasons:
i) Efforts are being made to trace the impersonator (A-1) namely Tmt.Bala in Cr. No.88/2017 and he has to be interrogated to ascertain the real facts of this case.
ii) To secure the absconding accused A-6 namely Tr.Dinesh Kumar in Cr. No.130 of 2019 and he has to be interrogated to ascertain the real facts of this case.
iii) To verify whether any other accused involved int his case iv) To collect the Thumb impression of one Tmt.Bala who is the mother of A-2 and the same will be sent to Finger Print Bureau for comparison of Original document.
4. Though investigation has been almost completed, it seems due to the above reasons charge sheet is not filed. Hence, I feel a short accommodation should be given to the third respondent to file the final report.
5. In view of the above stated reasons, the time already granted is further extended for a period of three months from the date of receipt of a copy of this order.
