(per ctn 17.5 kgs) VP of quantity 962.5 kgs, Fresh Apples NZ Queen Size 70/80/90/100/110 pcs (per ctn 17.5 kgs) Vp of quantity 21,367.5 kgs & Fresh Apples NZ Queen Size 120/135 pcs (per ctn 17.5 kgs) VP of quantity 12,932.5 kgs respectively imported vide Bill of Entry No.6592170 dated 26.06.2023 with Assessable Value Rs.18,61,610.

02/- under section 111(d) of the Customs Act, 1962, and quash the same as arbitrary, illegal and further direct the respondent to release the goods under import being perishable in nature and meant for human consumption, and direct the office of the respondent to issue a "Detention Certificate" for waiver of demurrage and container detention charges, in terms of Regulation 6 (1)(l) of Handling of Cargo in Customs Areas Regulations, 2009.

Learned counsel for the petitioner submits that since the subject goods have been provisionally released pursuant to the directions issued by the Hon'ble Supreme Court in S.L.P.(C)No.5159 of 2024, nothing survives for further adjudication in this writ petition.
