HEMALATHA CRIMINAL MISCELLANEOUS PETITION No.12800 of 2021 IN CRL.A.No.479 of 2021 SELVENDHIRAN [ PETITIONER / APPELLANT ] Vs STATE REP BY [ RESPONDENT / COMPLAINANT ] THE INSPECTOR OF POLICE, PATTABIRAM POLICE STATION, CHENNAI (CRIME NO.55 OF 2010) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition the petitioner shall at Trichy and report before the Town police Station daily at 10.30 a.m., imposed on the petitioner in Crl.MP.No.7431 of 2020 in C.A.No.479 of 2020 on the file of this Hon'ble Court.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.R.RAGAVENDRAN, Advocate for the Petitioner and of M/S.R.MUNIYAPPARAJ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- (Made by P.N.PRAKASH,J.) This petition has been filed to modify the bail condition imposed by this Court vide order dated 23.12.2020 passed in Crl.M.P.No.7431 of 2020 in Crl.A.No.479 of 2020.

This Court, by order dated 23.12.2020 in Crl.M.P.No.7431 of 2020 in Crl.A.No.479 of 2020, granted suspension of sentence and bail to the petitioner on certain conditions, one of which is that the petitioner should stay at Trichy and report before the Town Police Station, Trichy, daily at 10.30 a.m. until further orders. 3.

Heard Mr.R.Ragavendran, learned counsel for the petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor appearing for the respondent/State.

On instructions, the learned Additional Public Prosecutor submitted that the petitioner has been complying with the said condition since his release.

In such view of the matter, this criminal miscellaneous petition stands allowed and the aforesaid condition is modified as follows:

"The petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court." The rest of the conditions imposed by this Court in order dated 23.12.2020 passed in Crl.M.P.No.7431 of 2020 in Crl.A.No.479 of 2020 shall remain the same.
