..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 1st Respondent to process the petitioner's passport application No.TR01C5003375121 dated 17.01.2021 without insisting order from the Court pertaining to the case pending PRC No. 40/2022 before the District Munsif cum Judicial Magistrate Court, Vedaraniyam in connection with Crime No.87 of 2018 on the file of the 2nd Respondent, in the light of the order dated 02.06.2023 passed by this Honourable Court in W.A.No.902 of 2023.

ORDER

This writ petition is filed to process the passport application filed by the petitioner.

2. Learned counsel for the petitioner would submit that the petitioner has applied for passport vide application No.TR01C5003375121 dated 17.01.2021 along with requisite fee. However, the same was not issued to him. Hence, he filed this writ petition for issuance of passport without insisting order from the Court pertaining to the case pending PRC No.40/2022, before the District Munsif cum Judicial Magistrate Court, Vedaraniyam in connection with Crime No.87 of 2018 on the file of the second respondent, in the light of the order dated 02.06.2023 passed by this Court in W.A.No.902 of 2023.

3. Learned Government Advocate (Crl.side) appearing for the second respondent would submit that the aforesaid crime No.87 of 2018 has been numbered SC.No.20 of 2024. Hence, this Court may direct the petitioner to approach the concerned Court, where the criminal case is pending and get the order to process the passport application.

4. Heard the learned counsel on either side and perused theme materials available on record.

5. Such view of the case, this Court directs the petitioner to approach the Criminal Court, where the criminal case is pending to get appropriate orders for processing the petitioner's application.

With the aforesaid direction, this writ petition stands disposed of. No costs.
