ORDER : The Court Made the following order :- (The case has been heard through video conference) In Crl.O.P.No.22630 of 2021, the petitioner who was arrested and remanded to judicial custody on 13.11.2021 for the offence under Section 7(a) of Prevention of Corruption Act 1988 as Amended by the Prevention of Corruption Act (Amendment) 2018 in Crime No.10/AC/2021, on the file of the respondent police, seek bail. In Crl.O.P.No.22691 of 2021, the petitioner who was arrested and remanded to judicial custody on 12.11.2021 for the offence under Section 7(a) of Prevention of Corruption (Amended) Act, 2018 in Crime No.10/AC/2021, on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioner in Crl.O.P.No.22691 of 2021 is a Zonal Deputy Thasildar and he is arrayed as A1 and the petitioner in Crl.O.P.No.22630 of 2021 is a Revenue Inspector and Village Administrative Officer and he is arrayed as A2. On the demand and directions of A1, A2 accepted a sum of Rs.20,000/- as bribe from the de facto complainant for the issuance of Genuinty Report for the de facto complainant's father's land situated at Kudakarai Village, Nambiyur Taluk, Erode and handed over the money to A3 who is a private person. Hence, the complaint.
3. The learned counsels for the petitioners would submit that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. The learned Counsels would further submit that the petitioners have been suffering incarceration for more than 20 days and hence, prayed for grant of bail to the petitioners.
4. The learned Government Advocate (Crl. Side) raised strong objection stating that the investigation is at the initial stage.
5. Considering the nature of allegations levelled against the petitioners and the fact that the investigation is at the initial stage, this Court is not inclined to grant bail to the petitioners.
