ORDER

The present criminal original petition has been filed to modify the condition imposed on the petitioner in Crl.M.P.No.1996 of 2016 in Crime No.1080 of 2016 dated 16.12.2016 on the file of the learned Principal Sessions Judge at Dharmapuri.

2. It is the case of the petitioner that in connection with a case in Crime No.1080 of 2016, she was arrested on 6.12.2016. Immediately, she moved a bail petition before the learned Principal Sessions Judge at Dharmapuri in Crl.M.P.No.1996 of 2016 and the learned Judge, granted bail to the petitioner by imposing certain conditions. One of the conditions is that the petitioner should deposit a sum of Rs.50,000/- before the learned Judicial Magistrate, Pennagaram. Since the petitioner is very poor, she is unable to deposit the said amount. In view of the same, the petitioner is not in a position to avail the benefit of the said order. modification of the said order, the petitioner has come up with the present petition.

3. Learned Additional Public Prosecutor has no serious objection to modify the said condition imposed on the petitioner.

4. Considering the facts and circumstances of the case, this Court is inclined to delete the said condition imposed on the petitioner.

5. Accordingly, the condition imposed on the petitioner in Crl.M.P.No.1996 of 2016 dated 16.12.2016, by the learned Principal Sessions Judge Dharmapuri, viz., "the petitioner shall deposit a sum of Rs.50,000/-" is hereby deleted. The other conditions shall remain unaltered. The criminal original petition is ordered accordingly.
