C.M.P.Nos.21709, 21711, 21733 & 21770 of 2023 in S.A.No.1569 of 2010 G.ARUL MURUGAN, J., In this Second Appeal, the first appellant died on 14.04.2023 and C.M.P.No.21733 of 2023 is filed to substitute the legal heirs.

2. The second appellant also died on 17.03.2021 and C.M.P.Nos.21709, 21711 & 21770 of 2023 are filed to (i) condone the delay of 381 days in filing application to set aside the abatement, (ii) set aside the abatement, (iii) bring on records of the legal heirs of the deceased 2nd respondent, respectively.

3. Heard the counsel and perused the affidavit filed in support of the petition.

4. Having satisfied with the reasons stated in the affidavit, the C.M.Ps are ordered. Registry is directed to carry out necessary amendments in the Second Appeal and remove the name of Mr.T.Sezhian, counsel for the appellants, in the cause list.

5. Post the Second Appeal after two weeks.
